Matheu Nunn, a Partner and Co-Chair of Einhorn Barbarito Frost & Botwinick PC’s Family Law Practice, and Linda Torosian, Associate in the Family Law Practice, co-authored an article in the New Jersey Law Journal explaining why they would like a rule change allowing them to use prior instances of untruthful conduct to attack the other party’s character for untruthfulness.
As the authors explain, the rules prohibit attacking the other litigant’s character based on untruthfulness. Changes were made to N.J.R.E 608 in 2020, and while they were a step in the right direction, they do not go far enough to ensure truthfulness prevails in family court.
