Matthew James Troiano to Chair Criminal Practice Group

Einhorn, Barbarito, Frost & Botwinick, PC is pleased to announce that former Morris County Chief Assistant Prosecutor Matthew James Troiano has joined the firm as Counsel and Chair of its Criminal Practice Group, which will focus on providing clients with criminal defense and guidance on complex investigations.

Troiano, who is known throughout the State for his successful prosecution of many high-profile murder cases, has been a prosecutor since 2006, and with the Morris County Prosecutor’s Office since 2011. During his prosecutorial career, Troiano has successfully tried many jury trials in the New Jersey Superior Courts, including murder, aggravated manslaughter, aggravated sexual assault, sexual assault, kidnapping, aggravated assault, robbery, burglary, weapons, drugs and domestic violence-related crimes. He has also appeared before the Appellate Division of the New Jersey Superior Court.

Troiano is recognized by the New Jersey Supreme Court as a Certified Criminal Trial Attorney.  Certified attorneys have demonstrated high levels of experience, education, knowledge and skill in criminal law, and have been recognized by their peers as having sufficient skills and reputation in the field of criminal law.

In addition to his experiences as a successful trial attorney, Troiano has been responsible for the supervision and management of many prominent cases, including numerous death investigations, and has worked collaboratively with attorneys and law enforcement professionals from multiple agencies. These experiences have required him to navigate high-profile situations, which often involve public scrutiny and extensive interaction with the media.

Troiano’s investigative and trial experiences have been reported in broadcast documentaries including 48 Hours and Deadline: Crime with Tamron Hall.

“Matt is uniquely positioned to resolve serious criminal charges for many clients, based upon his insight as a former prosecutor and his thorough understanding of every stage of the State’s case from the initial investigation through the grand jury process, and ultimately, to trial if needed,” added Gary R. Botwinick, Co-Managing Partner of the firm.

Troiano’s career as a prosecutor began in 2006 with the Hudson County Prosecutor’s Office, where his primary assignment was to the Special Victim’s Unit, handling sex crimes, domestic violence, child abuse and homicide cases.  During this time, he tried numerous jury and bench trials before criminal and family judges of the Superior Court.

Troiano joined the Morris County Prosecutor’s Office in April 2011. In early 2014, he was promoted to a supervisory role in the Major Crimes Unit.  In July 2015, Troiano was promoted to Chief Assistant Prosecutor, a position he held until he left the Office to join Einhorn Barbarito.  As a Chief Assistant Prosecutor, Troiano was responsible for the legal supervision of the Tactical Units within the Office, including the Major Crimes, Fire-Environmental, Sex Crimes-Child Endangerment, and Domestic Violence Units.

Troiano stated, “Having spent over a decade involved in criminal investigations and prosecutions, I have seen firsthand what it takes to build a successful case and can offer advice and insight as to how to navigate the criminal process. I am here to help those who may be the subject of an investigation, under arrest, or going through a serious ordeal that requires knowledge of the criminal justice system. Most importantly, if there is a matter that needs to be brought before a jury, my experience will be a tremendous asset to my client.”

Troiano has been brought into Einhorn Barbarito to run a practice group dedicated to addressing the needs of clients facing very serious consequences. He will lead a team of experienced attorneys including Partner Michael R. Ascher, a former New Jersey Deputy Attorney General and Assistant County Prosecutor, Counsel Brian D. Kenney, a former Morris County Assistant Prosecutor and experienced criminal defense lawyer, and Partner Matheu D. Nunn, a former Morris County Assistant County Prosecutor and Municipal Prosecutor, whose recent arguments before the Appellate Division have resulted in new law and reported opinions. Ascher stated, “We are delighted to welcome Matthew into the practice and look forward to his leadership and vision for growth.”

Since 2010, Troiano has been an Adjunct Professor of Appellate Advocacy at Seton Hall Law School in Newark. He also spent 5 years as an Adjunct Professor at Essex County Community College teaching various classes in the area of Criminal Justice. Troiano has been a frequent instructor throughout the State in the area of criminal law and procedure, including teaching in the areas of interview and interrogation, search and seizure, police use of force and officer-involved shootings, strategic motion practice, and effective death investigations.  He served as a liaison to the New Jersey Child Fatality Review Board and as a panelist or speaker at Seton Hall Law School, Rutgers University, the Criminal Law Section of the New Jersey State Bar Association, the New Jersey Criminal Law Institute, and the New Jersey Association for Justice.

Troiano received his J.D. from Seton Hall University School of Law, and his B.A. in Criminal Justice from the University of North Carolina at Charlotte.  Upon graduating from law school, Troiano served as a law clerk to the Honorable Michael R. Casale, J.S.C. (Ret.), Essex Vicinage.
