Dennis Shlionsky Publishes New Jersey Law Journal Article Examining the Limits of Video Evidence and the Jury’s Role in Determining Fault in New Jersey Personal Injury Cases

Personal Injury Partner Dennis Shlionsky‘s article, “Who Decides? Dolson as a Guide, Not a Gavel, and the Jury’s Role in Rear-End Collision Cases: Lessons from Plonski v. Amador-Hodgson,” published by the New Jersey Law Journal, examines a recent Appellate Division decision reaffirming that there is no such thing as automatic liability in rear-end collision cases.
Drawing on the court’s decision in Plonski v. Amador-Hodgson, Shlionsky explains that while video footage may capture a collision, it does not always reveal what caused it. As he notes in the article, “The story may seem obvious, but trial lawyers know this is when preparation is most important. At such times, a jury may be needed most.”
The article explores why disputed questions of fault and causation often require a full evidentiary record and why juries remain essential to resolving those disputes fairly.
