Results may vary depending on your particular facts and legal circumstances.Christopher L. Musmanno, personal injury attorney with Einhorn, Barbarito, Frost, Botwinick, Nunn & Musmanno, PC, reached a settlement in the case of a Plaintiff, age 40, who was driving in a vehicle with his wife and two children when the Defendant, operating a garbage truck, crossed over the double yellow line into oncoming traffic and struck the Plaintiff’s vehicle. The impact caused the Plaintiff’s vehicle to spin out and strike a curb before the garbage truck collided with a third vehicle traveling behind the Plaintiff. The Defendant admitted to falling asleep at the wheel and was allegedly intoxicated at the time of the accident.
As a result of the collision, the Plaintiff was trapped in his vehicle with his legs pinned under the engine/dashboard. It took approximately forty minutes to extract the Plaintiff using the “jaws of life.” Once freed, the Plaintiff was air-lifted to the hospital where he underwent surgery for fractures in both legs and required skin grafting surgery to close the wounds. The case settled for a total amount of $640,000.
