Matheu D. Nunn Co-Authors “Cohabitation Frustration No More: New Ruling Clarifies the Prima Facie Burden” in New Jersey Law Journal

Nunn and Taryn Zimmerman, a partner with DeTomasso Law Group, co-authored a New Jersey Law Journal article discussing the New Jersey Supreme Court’s August 8, 2023 decision in Cardali v. Cardali 255 N.J. 85 (2023) which provided much needed clarity on the issue of cohabitation. Nunn and Zimmerman represented the prevailing party in the Cardali matter.
The article provides background on the significance of the issue in family law matters, highlighting the more than 60 appeals involving cohabitation since 2014. The authors touch on milestone cases leading up to the Cardali decision, while detailing the principal issues addressed in the Cardali decision that help establish cohabitation in family law matters, such as competent evidence, the procedure for prima facie showing, burden of proof, and discovery.
