The New Jersey State Supreme Court issued an order on November 18th which allows remote proceedings to continue, providing a glimpse of what future court operations will look like after the pandemic.
Several New Jersey-based attorneys are pleased with the decision as it is more efficient in many situations, but they are also cautious about how it will impact certain types of trials and hearings.
Matheu D. Nunn, Partner and Co-Chair of Einhorn Barbarito Frost & Botwinick PC’s Family Law Practice, noted that in-person dynamics are more effective in certain situations. “Something is lost – both in a jury and a bench trial – when witnesses’ mannerisms [such as nervously twitching, constant shifting of body position] cannot be seen firsthand.”
The Supreme Court is still working to provide specific guidance on jury trials and civil bench trials and continues to deliberate how to conduct complex civil jury trials.
