Einhorn Barbarito Partners Examine Evidence Issues in New Jersey Family Part Trials in New Jersey Law Journal Article
October 22, 2026The New Jersey Law Journal published the article “Common Evidence Issues in Family Part Trials (Part IV),” co-authored by Einhorn Barbarito’s Managing Partner Matheu D. Nunn, Co-Chair of the firm’s Family/Matrimonial Practice and Appellate Practice, and partner Matthew J. Troiano, Chair of the firm’s Criminal Practice Group and member of the Appellate Practice.
The article is the fourth installment in a series of articles the firm contributed to the New Jersey Law Journal. The first two articles focused on substantive evidence issues, while the third reviewed the “in-court” use of the rules. The fourth article returns to the topic of substantive evidence, emphasizing the critical role of the rules of evidence in evaluating contested facts in Family Part proceedings.
Specifically, the authors discuss expert evidence and New Jersey’s adoption of the Daubert standard for evaluating the reliability and admissibility of expert testimony, as well as the state-of-mind exception to the hearsay rule. They also examine the admissibility of statements contained within business records, noting that “each statement needs its own hearsay passport,” particularly those involving medical diagnosis or treatment and allegations of child abuse, and the distinct evidentiary requirements that apply to each.
