Christopher L. Musmanno Secures $300,000 Policy Limits Settlement in Fatal Pedestrian Accident

Christopher L. Musmanno, Chair of the Accidents/Personal Injury practice and a Certified Civil Trial Attorney by the Supreme Court of New Jersey, obtained a $300,000 policy limits settlement on behalf of the estate of a 66-year-old woman who sustained fatal injuries after being struck by a motor vehicle while crossing Flanders Road in Mount Olive, New Jersey.

According to the claims in the case, the decedent was a pedestrian utilizing a marked crosswalk to cross Flanders Road toward Turkey Brook Park from Wynnewood Avenue when the defendant, who was operating a motor vehicle, failed to stop and struck her in the crosswalk. The force of the impact caused the decedent to be thrown several feet into the air before violently striking the ground.

“Pedestrians have a right to expect that motorists will exercise appropriate care, particularly when they are crossing within a marked crosswalk,” said Musmanno. “When that responsibility is ignored, the consequences can be devastating.”

The decedent was transported to Morristown Medical Center, where her condition unfortunately worsened shortly after her arrival. She sustained multiple serious injuries as a result of the collision, which ultimately led to her untimely death.

The matter settled for the defendant’s total available policy limits of $300,000.
