Appellate Practice Group Co-Chair and Partner Bonnie C. Frost Quoted in New Jersey Law Journal Following Oral Argument Before the Supreme Court on Behalf of the New Jersey State Bar Association
September 26, 2024“Lawyers’ Ability to Buy Competitor’s Name as Keyword Mulled by NJ Supreme Court,” published by the New Jersey Law Journal, quoted Partner Bonnie C. Frost, in its coverage of the September 24 oral argument before the Supreme Court in the matter In Re Supreme Court Advisory Committee on Professional Ethics Opinion No. 735. Frost, who co-chairs the Firm’s Appellate Practice Group with partner Matheu D. Nunn, presented oral argument on behalf of the New Jersey State Bar Association to urge reconsideration of Advisory Committee on Professional Ethics (ACPE) Opinion 735, which allows attorneys to use another attorney’s name or law firm name as a keyword search to redirect searches to the competing attorney’s website. Addressing the court, Frost stated, “We ask not only that you vacate this decision but that you also make an affirmative statement to the bar so that they realize and can guide their behavior in the future.” She added that the practice in question is deceptive and misleading, and the behavior of buying someone else’s name for monetary gain should be addressed by this Court.
