$745,000 Total Settlement For Motorcycle Accident
Results may vary depending on your particular facts and legal circumstances.Plaintiff, presently twenty-seven (27) years of age, and a passenger on a black 2004 Harley Davidson motorcycle operated by defendant. Defendant, who was legally intoxicated at the time of the accident, lost control of the motorcycle, ran off the roadway to the right, and struck a guardrail. Plaintiff was violently ejected from the motorcycle approximately 25 to 30 feet into a rock wall. Plaintiff was found unresponsive at the scene and air medical was immediately requested.
Plaintiff sustained multiple spinal fractures and head injuries. Based on the severity of her injuries, plaintiff was admitted to the surgical intensive care unit for 15 days and remained intubated and on a mechanical ventilator until she could be extubated on August 5, 2018. She was then transferred to a rehabilitation institute for brain injury rehabilitation.
Defendant driver was overserved by a second defendant, a food and beverage establishment licensed to serve alcoholic beverages to persons over 21 years of age.
The case settled for a total amount of $745,000 from both defendants.
