$295,000 Settlement Following Rear Automobile Collision

Christopher L. Musmanno, personal injury attorney with Einhorn, Barbarito, Frost, Botwinick, Nunn & Musmanno, PC, reached a settlement in the case of a Plaintiff, age 53,  who was fully stopped at a red traffic light when his vehicle was struck in the rear by another vehicle. Plaintiff’s vehicle sustained substantial property damage, was towed from the scene, and ultimately declared a total loss. Plaintiff was in pain at the scene of the accident but was extremely reluctant to consult with a medical provider due to the COVID-19 pandemic. Plaintiff therefore returned home where he rested, utilized over-the-counter pain medication, and modified his activities. However, his pain continued to rise in terms of frequency and intensity, specifically in his left knee, right shoulder and lower back, which required knee surgery and lower back surgery.  The case settled for a total amount of $295,000.00.
