Plaintiff, age thirty-nine (39) years of age at the time of this accident, was a passenger in a stopped vehicle, waiting to make a left turn. The defendant failed to make proper observations and struck the rear of the vehicle. The impact was so severe that it pushed Plaintiff’s vehicle into an oncoming vehicle. As a result of the accident, Plaintiff sustained a lower back herniation which require surgery. The case settled for a total amount of $ 150,000.00.
