Plaintiff, was fifty (50) years of age, when he was involved in two serious motor vehicle accidents, less than one year apart. In the first accident, the defendant negligently, carelessly, and recklessly, operated the aforesaid motor vehicle by failing to make proper observations, take evasive actions, failed to maintain directional control of his vehicle, and struck Plaintiff’ s vehicle while traveling on Route 80. After the impact, Plaintiff was rendered unconscious and was awoken by police. In the second accident, Plaintiff was traveling in the center left lane on Route 80 East and was struck in the rear, causing him to strike the guardrail, re-enter the roadway and then get struck by a dump truck.
