According to the claims in the case, the plaintiff was driving when a dump truck abruptly changed into the left lane, striking the rear of her vehicle. The impact caused her vehicle to crash head-on into a guardrail.
The collision aggravated pre-existing injuries to the plaintiff’s neck, ultimately requiring surgery.
“One of the more common misconceptions in personal injury cases is that a pre-existing condition prevents someone from recovering damages,” said Musmanno. “The law recognizes that when another person’s negligence worsens an existing injury, the consequences can be every bit as significant as a new injury. The focus is on what changed because of the collision.”
The matter settled for $460,000.
