A 39-year-old male Plaintiff was involved in a serious motor vehicle accident where the impact was so severe, the defendant’s truck rolled onto its side and Plaintiff’s vehicle spun several times.  He was diagnosed with a herniated disc in his lower back, causing him extreme pain and a partial tear in his right shoulder. With regard to his shoulder, plaintiff underwent a arthroscopic repair of the rotator cuff, SLAP and labrum, as well as subacromial decompression and acromioplasty; lysis of adhesion with manipulation under anesthesia; distal clavicle resection and major debridement.

Following his shoulder surgery, he underwent a course of post-operative physical therapy.  Once he concluded his post-operative physical therapy pertaining to his shoulder, he returned to his treating physician concerning his persistent back pain.  Since his course of conservative treatment concerning his back failed to alleviate his pain, he was recommended lumbar surgery.  On March 14, 2018 he ultimately underwent lumbar hemilaminectomy, foraminotomy and discectomy, left L4-5. Due to his surgeries, Plaintiff was unable to work for 15 months and had a significant lost wage claim.

The case settled at the time of Mediation for $480,850 on April 29, 2019.
