$295,000 Settlement for Motor Vehicle Accident

Plaintiff, presently fifty-seven years of age, was operating a vehicle in Newark, NJ when she was struck in the rear, and then struck a second time by the same vehicle. The impact was so severe that Plaintiff fractured her right lateral fifth, sixth and seventh ribs, in addition to injuring her neck, lower back and right shoulder. MRI studies of her spine indicated that she suffered a lower back hernation and a herniation in her neck. The severity of her cervical and lumbar herniations was confirmed by EMG studies which indicated evidence of right C5-C6 radiculopathy and right L5-S1 radiculopathy. An MRI study of her shoulder demonstrated tendinosis and a partial tear along the undersurface of the supraspinatus tendon near its insertion.

After conservative treatment failed, Plaintiff underwent lumbar fusion surgery at two levels with the implementation of a tritanium cage.

The case settled on June 5, 2019, for $295,000, which represented the limits of the defendant’s policy and Plaintiff’s own underinsured motorist coverage.
