Results may vary depending on your particular facts and legal circumstances.Plaintiff, presently thirty-three (33) years of age was a restrained, front-seat passenger in a vehicle fully stopped for traffic in a maintenance zone. At the same time, a vehicle owned and operated by Defendant was traveling directly behind Plaintiff’s vehicle in his lane of travel. Defendant struck Plaintiff’s fully stopped vehicle in the rear at an excessive rate of speed without warning. The force of the impact was so great that both vehicles were totaled.
Plaintiff initially did not present to the hospital because he thought he was suffering from some minor pain and soreness. When his pain increased both in terms of frequency and intensity he consulted with his primary care physician and began conservative treatment. The conservative treatment failed and additional diagnostic testing was indicated, which revealed significant lower back injuries. Plaintiff ultimately underwent a fusion surgery.
The case settled on June 25, 2019 for a total amount of $250,000.
