Plaintiffs (driver and passenger) were struck by a Ford commercial truck owned by Defendant, New Jersey Department of Treasury, and operated by was attempting to enter Route 15 South from the maintenance yard parking lot. The vehicle negligently failed to yield to Plaintiffs’ right of way, failed to maintain proper observations, and/or otherwise failed to take evasive action when he crossed over two (2) lanes of travel on Route 15 South and essentially sideswiped the front passenger-side of Plaintiffs’ vehicle while he attempted to exit the maintenance yard. The force of the impact was so great that Plaintiffs’ vehicle was propelled to the left into a guardrail. Plaintiff driver suffered very serious injuries, including a comminuted fracture of the right acetabulum extending into the iliac wing with numerous bone fragments involving the superior acetabulum, the posterior acetabulum, and the inferior acetabulum accompanied by posterior right hip joint dislocation; acute fractures to left ribs 2, 3, 4, and 5 and a displaced fracture through the anterior maxilla with displaced right central incisor. The following day he underwent open reduction and internal fixation of his right hip fractures. He was admitted into the hospital for recovery.

Plaintiff passenger suffered disc herniations and upper and lower extremity radiculopathy. During mediation, the matter settled on June 17, 2019 for a total of $1,150,000 ($1,100,000 as to Plaintiff driver; $50,000 as to Plaintiff passenger)
