$1,000,000 Settlement in Motor Vehicle Accident

Dennis Shlionsky, Partner in the Personal Injury Group, secured a $1,000,000 settlement in a motor vehicle accident matter. The firm’s 45-year-old client was rear-ended in Keyport, sustaining neck and back injuries that required surgery. The defense emphasized minimal impact, lack of visible property damage, no emergency room treatment, gaps in care, and a prior L5-S1 herniation from a 2018 work-related injury at the same surgical level. Plaintiff’s counsel retained a neuroradiologist who identified a distinct, superimposed right-sided herniation, corroborated by EMG findings and supported by treating physician testimony. 

Shlionsky noted, “Prior injury at the same level does not end the inquiry; the question is whether there is new pathology, and here, the objective evidence made that clear.”
