$325,000 Settlement For Customer Injured At Home Improvement Store

Plaintiff was  shopping in a home improvement store when employees who were unloading a cart full of PVC and metal products in the same aisle. As the employees unloaded the cart, the cart became unstable and toppled over knocking Plaintiff to the ground and crushing his leg.  Plaintiff had his back to the cart when it unexpectedly tipped over, knocking into Plaintiff and causing severe ankle and leg fractures. Plaintiff required surgery, but had to wait until the extensive swelling subsided and was hospitalized during that waiting time. Eventually, the doctor performed open reduction and internal fixation. As a result of the incident, Plaintiff’s neurological sensation to his leg and foot are diminished, and he will need continual therapy for muscle strengthening and nerve stimulation. Unfortunately, Plaintiff will most likely have the loss of sensation to his lateral leg due to the crush injury for his lifetime.  Plaintiff was fifty-one ( 51) years of age at the time of this accident.  The case settled for a total amount of $325,000.00.
