Plaintiff, sixty (60) years of age at the time of this accident, was a passenger in a vehicle that struck another vehicle in the rear. The force of the impact was so great that the vehicle in which Plaintiff was a passenger was declared a total loss. At the scene of the accident, Plaintiff complained of pain and was evaluated by emergency medical personnel. However, she went home because she was under the mistaken impression that she was suffering from minor soreness that would resolve on its own. It soon became evident that she would require immediate medical attention as my pain increased in frequency and intensity. Plaintiff was diagnosed with cervical herniations which required a two level anterior C4-5 and C5 discectomy, partial C5 corpectomy and fusion procedure with instrumentation.

The case settled for a total amount of $100,000.00, which represented the policy limits.
