New Jersey Supreme Court Finds Palimony Agreement Enforceable

In the matter of Moynihan v. Lynch, Bonnie C. Frost, a Partner and member of Einhorn Barbarito’s Appellate Practice and Family Law Practice, was a co-author of an amicus curiae brief submitted by the New Jersey Chapter of the American Academy of Matrimonial Lawyers in support of a plaintiff seeking enforcement of a palimony agreement. On March 8, Justice Albin of the Supreme Court of New Jersey held that the palimony agreement was enforceable, finding unconstitutional a law which requires all signatories to a palimony agreement to have the advice of a lawyer.
