Nunn, Wolff and Torosian Obtain Published Appellate Division Decision in Favor of Firm’s Client
December 10, 2025In the matter of A.C. vs. R.S., the Superior Court of New Jersey Appellate Division issued a published decision on behalf of the defendant-appellant represented by Firm lawyers Matheu D. Nunn, Steven H. Wolff, and Linda Torosian. The published decision reversed a final order of protection wrongly entered against their client under the Victim’s Assistance and Survivor Protection Act, N.J.S.A. 2C:14-13 to -21 (VASPA).
“Although VASPA is an important statute designed to protect individuals in our state, we successfully argued that the allegations against our client did not meet the statutory definitions of lewdness and cyber-harassment,” said Nunn, managing partner of the Firm and chair of the its general Appellate Practice, adding, “In turn, the trial court should not have entered the order of protection against our client.”
Ultimately, the Appellate Division held that the plaintiff did not establish a predicate act under VASPA and reversed the trial court’s decision. “This appeal demonstrates why having the right appellate team – a team that compares the alleged facts against the judge’s decision and controlling legal precedent – matters,” said Nunn.
