On Thursday, June 5th, 2008, the plaintiff, Sandro Mazzola, a general foreman for a plumbing subcontractor of the third party defendant general contractor, was struck and run over by the defendant oil company’s truck when the driver backed up his fuel truck with no assistance of a flag man, traveling the wrong way down a one-way street on Madison Avenue in Hoboken. Mr. Mazzola could not get out of the path of the fuel truck in time to avoid the accident.
