Timothy J. Ford Quoted In Forbes Article, “Impact Of Covid On Civil Rights In Workplace Will Be Focus Of EEOC Hearing.”

Increased Litigation

Companies have already begun to face increased litigation as a result of the pandemic, according to Tim Ford, a partner at Einhorn Barbarito Frost & Botwinick. He noted that, “Many claims have arisen with regard to family leave under the Family and Medical Leave Act and Families First Coronavirus Response Act.”

He said, “Employees have alleged interference with job protected leave resulting from employees who have contracted coronavirus or have had to quarantine as a result of potential exposure. Family leave and the requirement to provide reasonable accommodations under the Americans with Disabilities Act and various state statutes are often the most complex issues employers face.”

Allegations Of Improper Practices

“In addition, a flood of complaints have been filed by alleged whistleblowers, claiming improper practices by employers as it relates to coronavirus restrictions. Departments of health and labor have seen increased complaints by employees over the past 14 months with allegations that employers have not adhered to required safety regulations or directives.”

Ford predicted that, “The result from these complaints may not be realized for years as courts struggle to handle an increased docket while in most states jury trials have been halted.”
