Plaintiff, fifty-eight (58) years of age at the time of this accident, was struck, head-on, when Defendant, negligently, carelessly, and recklessly operated the aforesaid motor vehicle by failing to maintain directional control of his vehicle, failing to make proper observations, and/or otherwise failing to take evasive action causing him to lose control of his vehicle, crossover the double yellow lines, enter Plaintiff’s lane of travel. As a result of the impact, Plaintiff’s vehicle spun 180 degrees and was propelled off the roadway into an embankment. Both vehicles sustained substantial property damage and were towed from the accident scene. Plaintiff immediately complained of pain. As a result of this accident, Plaintiff sustained the following injury: Perforated sigmoid colon with purulent peritonitis secondary to blunt force abdominal trauma, requiring sigmoid colon resection with end colostomy and future colostomy reversal surgery.
Based on the severity of his injury, he remained inpatient at Morristown Medical Center for approximately 17 days. The case settled for a total amount of $ 92,500.00
