Bonnie Frost Successfully Defends Client In Her 26TH Published Appellate Decision

In early May, 2013, Bonnie C. Frost, Esq. received notice that a case she argued in Appellate Court was decided in her favor.  This was Ms. Frost’s 26th Appellate Decision that was published, which means other attorneys throughout the state will rely on the holding of this case.  Ms. Frost is continuing to help set precedents and case law in the State of New Jersey.

At issue in this case, Reese v. Weis, was whether the defendant, Ms. Weis had received a substantial economic benefit as a result of her cohabitation with another after her divorce from Mr. Reese, so that the alimony Mr. Reese was paying could be terminated.   Mr. Reese had successfully proven at the trial level that Ms. Weis’ relationship with another man after her divorce had substantially and materially enhanced her lifestyle and therefore, the trial judge terminated alimony to Reese’s ex-wife.

Unhappy with that result, Ms. Weis appealed.  It was at this level that Ms. Frost successfully defended Mr. Reese’s right to eliminate alimony support payments to Ms. Weis.  The Appeals Court found that her 10 year cohabitation with her boyfriend showed that “the combined families (Ms. Weis and her three children and her significant other, Mr. Stein, and his two children) operated as a single household, with defendant (Weis) and Stein  were committed to each other economically, devoted to each other emotionally, and faithful to their monogamous union”.   

Ms. Frost, Esq. is a partner in the law firm of Einhorn Barbarito and concentrates her practice solely in matrimonial and family law. She has authored numerous works in the area, including the Women’s Legal Rights Booklet. She co-authored the State Bar, Family Law Section’s Position Paper on Matrimonial Law 1997. In addition to being a member of the State Bar Family Law Executive Committee since 1994, she is also a Certified Matrimonial Law Attorney, Fellow of The American Academy of Matrimonial Lawyers, and Chair of the Disciplinary Review Board, the intermediate Appellate body for the attorney disciplinary system.

Ms. Frost is the 2012 Recipient of the Saul Tischler Award bestowed upon her by the New Jersey State Bar Association Family Law Section.  The award recognizes the significant and substantial lifetime achievements and contributions to family law.  This case adds to the body of work.
