Plaintiff was 57 years old and stopped at an intersection waiting to make a left turn when she was struck in the rear by a commercial vehicle. As a result of the accident she sustained herniated discs at C5-6 and C6-7 which encroached on the anterior aspect of her spinal canal and spinal cord. She underwent conservative treatment which included an abnormal upper extremity EMG test. She also tore the medial meniscus in her knee. She underwent arthroscopic surgery to repair the torn medial meniscus in her knee and anterior cervical diskectomy and fusion surgery at two levels in her cervical spine. The defense contended that the injury to her neck was not related to the automobile accident, but, rather, a pre-existing degenerative problem. Her case was settled after picking a jury for $325,000.00.
