Plaintiff is the administrator of the estate of his brother. In December 2015 Plaintiff’s brother was a pedestrian in a crosswalk when he was struck by a tow truck operated by the defendant. EMTs indicated upon arrival that the decedent was breathing and had a detectable pulse. Unfortunately, shortly thereafter his condition worsened to traumatic cardiac arrest and he was transported via ambulance to the hospital. Upon entry to the trauma bay, no signs of life were noted and Plaintiff’s brother was pronounced dead.
The case settled for $200,000.00, prior to the scheduling of a trial.
