Decedent/Plaintiff was fifty-six (56) years of age at the time of this accident. He was a pedestrian crossing St. George Avenue, at or near its intersection with Harrison Avenue, in Roselle, New Jersey. At the same time and place, Defendant was operating a vehicle, traveling in a westerly direction in the right lane on St. George Avenue. Defendant switched from the right lane to the left lane because he allegedly observed the driver in front of him making a right turn. After switching lanes, he observed the decedent standing in the left lane approximately half way across the street near the double yellow line and struck the decedent. The decedent was propelled into the east bound lane where he was struck a second time by another vehicle. Decedent succumbed to an untimely death as a result of skeletal fractures with intracranial hemorrhage, cervical spinal epidural hemorrhage and liver lacerations. Defendant argued that decedent was wearing dark clothing, not walking in a crosswalk and was under the influence of alcohol at the time of this accident. The case settled for a total amount of $ 150,000.00.
